In the latest edition of The Federalist Society’s Engage, Alison Somin has a nice piece on Title IX in the Obama administration. Somin points to three key developments: the rescission of the Model Survey as a compliance mechanism, the controversy over whether cheerleading is a sport, and the potential expansion of Title IX into the sciences. One thing that I would add to that list is the attempted expansion of aspects of Title IX to the high-school level. That area has seen a lot of movement over the past two years and will likely continue to be a hot spot in the Title IX debate.
