In June, the Department of Education proposed new rules that purport to enforce Title IX, the federal law that prohibits sex discrimination in education. On September 12, Independent Women’s Law Center (“IWLC”) filed five specific objections to the proposal.

In its comment on the free speech implications of the proposed rule, IWLC explained the ways in which the proposed will usher in a new era of Orwellian speech monitors and enforced political correctness on campus. IWLC explained that the proposed rule invites liability far beyond what the statute contemplates and, thus, invites schools to violate the First Amendment rights of their students and faculty. Accordingly, IWLC asked the Department to withdraw the rule.
