WASHINGTON D.C. — Independent Women’s Law Center (IWLC) issued a response to the U.S. Supreme Court’s monumental order, released on Friday, which denies the government’s request to implement its Title IX rewrite in certain states where the rewrite is currently enjoined. The Biden-Harris Title IX rewrite upends the 1972 sex-discrimination law to erase protections for women, replacing sex-based protections with gender-identity based treatment.
Much of the order was issued unanimously. “All Members of the Court today accept that the plaintiffs were entitled to preliminary injunctive relief as to … the central provision that newly defines sex discrimination to include discrimination on the basis of sexual orientation and gender identity.” Four Justices would have permitted the government to enforce certain provisions of the regulation unrelated to gender identity. The majority of Justices did not find that the government met its burden to explain how the rule could be untangled.
The effect of this ruling is that the 26 states with injunctions against the rewrite in place maintain their injunctions.
The rules took effect on August 1st for the 24 states that have not filed lawsuits challenging the regulation.

All nine Justices believe the plaintiff states should not have to implement this illegal rewrite that discards protections for women in education. The Biden-Harris administration should stop its illegal quest to shove gender ideology into every school across the country. Not only is the Biden-Harris administration going to continue to lose, but this country should not be governed by administrative fiat, but by the will of the people, who overwhelmingly want to protect women’s rights.”
